Income tax scrutiny---urgent advise

Dear Experts

I had filed the return for financial year 2010/2011 last year in Juny 2010 and today I got a call from the Income tax office that a Scrutiny notice was sent to my address in Aug, 2011 which came undeliverd back to them.

Income tax officer told me over phone that I need to come to the Income tax office and receive the notice.

Kindly advise what can I do since I have not received the notice and please also advise whether this is VALID to call people to come and receive there notice?

Income tax office must have the address in there records.... Please advise what shall I do?

Income tax office is not court, they have vast powers. Just cooperate and give information needed so that the matter will be solved.

Cases are taken in scrutiny when some new major investments are made or credits shown.

Sir,

I want to know that If I have not received the scrutiny notice, what can I do?

Should I go the Income tax office and receive the same... Do Income tax people call People?

The notice is valid and in case of non attendance it will create problems in future. The notice was validly sent to the last known address of the assessee hence it is valid and deemend to be duly served.

Yes you need to go and collect the notice and IT department do call it is normal.

Thank you experts, let me shed some more light to the above..

I had a refund of Rs 1,14,000 from the Income tax office for assessment year 2010/2011 which I received in June,2011 after paying a bribe of Rs 10,000 to the person handling the same in the IT office ward.

That person was expecting Rs 20,000 to process the same to which I denied and yesterday I got the call from the same person telling me that a Scrutiny notice for 2010/2011 assessment year was sent to my address and it came unreturned from my address and I should come over to the Income tax office and receive the same...

In lieu of the above facts, Kindly advise me now what shall I do since he is expecting more money, I am a salaried person and has no other source of income except salary from my employer.

Dear Rahul,

Scrutiny is a normal process of the IT department for high income assessees. Legally, you have to cooperate with the department in that case. But, if you have received notice for the same assessment year after you received refund for the said year, you certainly have the edge to prove the mal-intention of the officer and can approach even senior officers or the vigilance department of the IT department with proper justification, if your income proof and claim of refund was correct.

Thank You Dhingra Sir for your expert advice.

I confirm that the scrutiny notice was sent to me for assessment year 2010/2011 ONLY after I received the refund with interest amounting to Rs 1,21,212.

Shall I go ahead and receive the notice by visiting the Income tax office in Mayur Bhavan, Cannuaght place? Or should I ignore the same?

Kindly advise.............. since I dont want to pay any more money to these income tax corrupt assholes.....(pardon me for using this language)

Rather following Anna's footsteps, I want to fight it, I have my valid income proofs and Claim of refund receive with me.

Please advise me Sir.

Yes, go ahead and receive the notice. If no notice was there, but the person was only angling for extra bribe money, if you feel like you can make a complaint in writing immediately and come back. In case if there is a notice, then meet the same by giving complete particulars.

Dear Rahul,

If you are fair and honest in your tax matters, to tackle such situations of bribe, you can have approach to three sources by filing a formal complaint to:

1) The head of vigilance wing of the department concerned;

2) Central Vigilance Commission; and

3) CBI to make red handed catch of bribe taker.
