Querist : Anonymous (Querist) 10 June 2011 This query is : Resolved 
our old building is under development, our builder paid us Rs. 7500/- as rent per month as per agreement made and we already vacated building one year back but some tenants vacated now and taken Rs 10000/- rent per month which is more than us. Now my query is that whether this increase rent difference we can claim/ask from builder to give us.

once you enter in the agreeement with your knowledge then how can ask difer amount, not possible.

you can simply negotiate with builder in persuasive manner but can not compel him for that. you can not back from your own agreement as of right,no court will provide any remedy against the terms of agreement.

The sum is usually given by way of compensation for the alternative arrangement & not for profit. So, unless U can show that the cost of your alternative arrangement has exceeded the amount,There is not much U can do about it.

This rent for the time of your relocation depends upon the individual agreements.
Once you agreed to move out @Rs 7500/- you an not ask for the increase unless you could show that your relocated rental charges has been increased in the meantime that too if there is such provision in the terms of your agreement with the developer.
