as a co owner of a building i have asked for the permission letter for the illegal construction going on in my building ,which the authorities cannot provide .Now i find out that the original drawing of the building is also not traceable and i think this is a co effort of the officials and the part owner who i think are trying to change the plan....i would request honorable members to advice me what can i do?

You issue the notice u/s 80 of CPC to the municipality and immediately file a suit for permanent injunction and obtain the TI as not to construct the building

If we issued notice to the municipality Under section 80 mean then how we can file a suit immediatly.. We have to wait 60 days from the date of notice..

Remedy suggested by the experts is not understood. They may like to clarify, what notice u/s 80 of cpc will do, if building plan is not available with the municipality? Will the notice create a building plan?
If you are the co-owner of the building, you must also be possessing a copy of the approved building plan. Why not provide copy of that plan from your side to place on record of the municipality?
If do not possess, any reason for not having the same?
