HRA Exemption

(Querist) 26 March 2011 This query is : Resolved
Dear Sir,

We have seen that employees are giving the details as he paid like Ten Thousand per month of rent.

For TDS calculation employer needs to get their receipt and they are also providing the same.

As a employer, do we need PAN of Landlord as per income tax act law is concerned for HRA benefit of employees?

Kindly suggest me the same.

Is it feasible?
At present there is no need to get the PAN of the land lord.
self declaration by the employee and the stamped, signed receipt by the land lord is enough.

Dear Raghav,

Would you like to create a permanent headache for you and all other employers to get more complicated the already complicated taxatiion matters, when an employee himself is accountable for any rebate claimed wrongly by him in lieu of House Rent paid by him?

You may however, keep your options open to get the matter verified through an indeendent investigator if you have some doubt about the integrity of any particular employee in the matter.

It is always better to keep your authority in your own hands rather than seeking commands from the law or other authorities on every trivial issue.
