i m a tenant residing in same place for 3yrs now. when we joined the society there were few cars, hence parking was easily available. now the no. of cars have increased , however still there is ample of parking space in the society. there is a new rule passed all of sudden to move all tenant cars out of the society and 2nd cars without the consent of the other members (car owners), just a bunch of committee members who dont even own cars.
since there is ample of parking space even after flat owners have occupied, still we r asked to move our cars away. however again a rule is passed stating any non-member can park their car in society premises at a monthly charge of rs.1500/-. is this justified? can the other society members challenge this rule passed just by 2-3 people. is there any bye-law stating any parking facility for the tenants, if there is ample of parking space? does alloting parking space mean ownership? of the place, or the parking lots can be slloted to ease the issue?

1- The Tenant will use the Parking place of the Flat owner
2- Whether Flat owner /land lord has any parking lot with Flat which is leased / or under licences to you
3- Society Rules & Bey laws
4- Report to your land lord about this - he has to insist for his parking lot to be used by his tenant/you .
5- However the Owners and Tenants have to follow the Bey laws - any illegality in this regard - Approach the Competent Authority on Societies

challnage the sid order in the COurt and let them justify their new rule. In the menwhile ask Court to grant the stay against them from removing / restraining your car from parking

If the owner has a car-parking space & he allows the tenant to use it then the tenant can, otherwise, he will have to pay the car-parking fees as imposed by the society.

Owners space can be used by the tenant.If there is any objection send notice to society and to the Registrar.
