471

(Querist) 16 December 2010 This query is : Resolved
I just wanted to query that in case of forgery acts such as 471, 476, 478 etc. can trial be made on the basis of only photocopies without being existence of original ones.

Since in photo state copies any thing could cut and pasted anywhere. So, is it possible to have trial on the basis on only photo copy documents.

No. It will not be a fair trial if it is on photocopies only.

Photo copy of any documents are not admissible in law, if it is made from the original, compared with original and found to be true in that case it may be treated as secondry evidence.

Photocopies are not primary evidence. The originals of documents are required to be produced in the court. If the originals are not available, the party has to seek permission of the court for producing photocopies by way of secondary evidence.
Advocate. Arunagiri (Expert) 17 December 2010
To prove that it is a forged document you need the original.

yes unless the same is admitted in the cross examination.
