Querist : Anonymous (Querist) 18 July 2010 This query is : Resolved
Please answer my query: "A" gives a all power by a Power of Attorney to "B",
1.Can "A" sell property by sale deed and register the same to "X" after giving power to "B"?.
2.Can "A" sell property to "B" itself, if so who have to sign the deed?
Devajyoti Barman (Expert) 18 July 2010
1. Yes
2. Yes, A will sign the deed.
G. ARAVINTHAN (Expert) 18 July 2010
Since A is the owner, he can anytime sell his property to anyone by himself. The agent will come in to picture only if A is not able to present.

Both can be done by A
adv. rajeev ( rajoo ) (Expert) 19 July 2010
Yes and yes A will sign the sale deed
B K Raghavendra Rao (Expert) 19 July 2010
But before selling he need to cancel the power of attorney as any act done by him without the knowledge of cancellation may become effective adverse to the owner's interest. A can sell property to B himself by signing a sale deed.
