dear sir, iam from the defence , a case is pending against my client in the trial court , as he has been accused of infringement of copyright in a literary work.. a chargesheet was filed before the trial court and there he was charged with section 68 of the copyright act.
my question is sir , is section 68 is sustainable or in other words is it applicable for the alleged offence. and moreover in the chargesheet the author of the book is not the complainant it is the police who has filed a complaint... as per the provisions of the copyright act the owner of the copyright is entitled to maintain a criminal action .

If the police officer is aggrieved directly or indirectly then have the right to file a complaint. How the police officer is related to the case? They have the right to register FIR.
