Dear Sir / Madam,

We want to give our shop for rent. Please suggest whether the rental agreement period shall be less than one year (11 months) or it can be for more period. Whether the rental agreement needs to be registerd or not.

Kindly suggest.

The Lease(rental) agreement for any period shall be registered in many states. There is a provision that a lease deed below one year is not a compulsory registerable document in some states. So, consult the local Sub Registrar's office. The lease or rental agreement for more than a year shall be registered in any state.

As per the latest rent control act, which has been enacted in almost many states across the country, an 11-month rental agreement , as per the latest Rent Control Act, is not mandatorily required to be registered. The Act mandates registration for all tenancy agreements, but agreements with a duration of less than 12 months (including 11 months) are generally not required to be registered under the Registration Act. However, the Act does require all tenancy agreements, whether registered or unregistered, to be registered with the Rent Authority.
Agreements exceeding 11 months are mandatorily registered with the Sub-Registrar's Office.
While not mandatory for registration under the Registration Act, an 11-month agreement is still subject to registration with the Rent Authority.
The practice of using 11-month agreements is often employed to avoid the cost and hassle of registration under the Registration Act.

Get executed and registered a laase deed for long period ( fixed period ) it secured landlord rights and easier to get vacated the leased premises from lessee/tenant.

It is your mutual and personal decision, however, rent agreement for 1 year and above has to be registered.
