Security deposit versus rent.

(Querist) 10 April 2012 This query is : Resolved
I had rented out my flat on a company lease for a particular employee. However the company informed me my that the employee has resigned and they are no longer liable to pay rent. They have asked employee to pay rent for last month.I have immediately served one month notice to company and employee for vacating the leased premises.I feel I should not accept rent from employee because as I have no agreement with employee and I should rather adjust rent against security deposit of the company at the time of premises being vacated.I suppose company is responsible for the leased premises till it is vacated. Can anyone advise if any.

Dear Himanshu
what do you want?

You can do so.
But, there is no illegality in accepting the rent from the employee. Getting the rent is important and here you are getting the rent in a legitimate manner.

When the company given information about its employee's termination. What reply being given by the company against your notice. If they intimated already then why you are not force the ex employee of the company to vocate from your premises
