This query is : Resolved
I am a May 2010 law graduate, have been enrolled in my State Council, have passed the AIBE Exam and registered myself in the District Court.
Simultaneously, I have joined a full-time LL.M Course in June 2010.
My question is Whether I can be a practising Advocate and LL.M Student simultaneously?
If yes, can I appear for the Judiciary Examination for which the eligibility is that you should be a practising advocate?

If you are enrolled as an Advocate, and so long as you are not under the employment of anyone else,or do not indulge in any business activity, you can very well appear for the Judiciary Examination. Your pursuing the LL.M. regular course will not come in the way.

So I would like to ask further that whether the respective State Bar Council would have no objection on doing my LL.M. on a regular course?

There will be no objection whatsoever from any quarter and much less from the Bar Council.

There will not be any objection from any quarter unless you are in the employment government/PSUs etc.

As you shall be engaged in full time course of LLM, you cant be described as a practising Advocate during that period and if NOC is required simultaneously then Bar Council shall be hesitant legally.

thank you all. But I would like to submit that as under the provisions of Advocates Act and Bar Council Rules, an advocate cannot indulge in any other profession. However, there is no express provision anywhere which says that after getting enrolled as an Advocate you cannot join a full time academic course. I would like to request the experts to mention if there is any such provision.

Mr. Raj Kumar Makkad,
Thank you for your reply. I would like to know about the NOC that you mentioned. Are NOCs issued by Bar Councils as a general practice in cases like mine?
Further, I have talked about it with the Secretary of my state bar council and he said there is no objection on this.
