how to fight a case u/s 328/307 IPC if the CFSL report says, "no poison could be detected"?

Then the dcase under section 328 is not made out at all. u have to concede to the charge under section 307 of the IPC.

if no 328 then why and how 307 will lie?
file a petition u/s 227 crpc at the time of framing of charge and get the accd persons discharged.I think if the court is prudent enough ,then accd persons may be discharged.
