Sir, I have my own flat which i had given
to my tenant with a agreement for 3 yrs with a advance amount.but after 3yr themy tenant gave me posted written letter that he is quiting the tenancy but she didnt give the a vacat house due her husband .
she and her husband is running a divorce case but she have quit from my house.but her husband still have occupied my house and denied to vacat the flat and even he has also stopped to contact with me also.
what should i do now .please a advice.

First issue notice to your tenent under the Transfer of Property act by giving him time to vacate the house, if he failed to vacate then file a suit for possession.

file a complaint with local police station in your area against the person and seek remedy. otherwise issue notice to vacate the house and file a suit/op to evict in civil court.

Sir ,i have issued notice in her name .she have no problem with the notice but her husband delaying this issue.he claimed that he have the agreement with me but there is no agreement have done with me and him .the agreement made with me with the lady in her name not the guy.but he have claimed that he have the agreement with me and he can show this .judge is issueing date after date for discovery but he all the time stay absent or the judge is not coming.something always happeing in opposite to me.i am suffering from 2009.

we have made a partition deed with my relatives. one of them have died so should i have do the deed again.
