Applicability for ESI and PF

We are a mid size Trading organisation registered under Maharashtra Shop and establishment act.
We have a staff of 15 person.
Are we liable for ESI and PF ?

As the strength of your employees is below 20 so your concern is not liable to be covered under EPF & ESI Act.

The ESI Act, (1948) applies to the following categories of factories and establishments in the implemented areas:-

Non-seasonal factories using power and employing ten(10) or more persons
Non-seasonal and non power using factories and establishments employing twenty (20) or more persons.

Further, PF Act is applicable in case the number of empployees cross the threshold limit of 20 and continues even if the numbers recede the threshold level.
