thanx Vishal sir for your quick reply. Sir... in my case Chairman is the party (defendant)in a consumer suit. i want to make an application to delete the name of chairman. how?

Your advocate needs to file an application to that effect stating the position of the chairman as non executive post and a misjoinder to the suit & seek the permission of the court to delete the chairman from the proceedings.

This process is very easy. Complainant is the master of his case. If he wants to delete any of the respondents, he may do so by moving an application thereto.
