Sir, I have a building which is covered under Standard Fire and Special Perils Insurance. This insurance policy covers loss caused due to flooding. in October 2009 my house was damaged by flooding together with hitting of either floating Trees/boulders.
However the Insurance company has denied my claim on the ground that the loss was not caused by the floods but due to hitting of boulders.
My contention is that it was the flood which caused the damage,Does stones, tree logs coming with flooding water will vitiate the claim.
Please help me and if possible give case laws.
(Tsunami claims can be case in points)
