Querist : Anonymous (Querist) 26 May 2010 This query is : Resolved
Dear Experts,
My grandfather had some own earned property. After his death that property was divided among his sons, now my father passed away leaving behind a registered will in my favour for that land which he got from my grandfather. We are three brothers and sisters. My queries are:
1.Can my brother or sisters demand share in that property.
2.If, yes than is their anyway out.
3Is that ancestral property for me.

1.Can my brother or sisters demand share in that property.
Ans. Yes.
2.If, yes than is their anyway out.
Ans. There is no way out.
3Is that ancestral property for me.
Ans. No, your brother & sisters have equal right and share in the ancestral property.

Further, the will of your late father is invalid as far as the ancestral property is concerned however, it is valid to the extent of his own self acquired properties whether movable or immovable.

It is an ancestral property. All the legal heirs have equal rights over it.
