Querist : Anonymous (Querist) 27 April 2010 This query is : Resolved
Lnd. experts,
Is it possible to get title declaration on the basis of 40 yr old voidable registered sale deed of a land against the heirs of the vendor? Can plea of adverse possession or law of limitation be taken? Heirs of vendor is creating nuisance and trying to take back the possession of the land after 40 yrs of sale. Thanks to all.
adv. rajeev ( rajoo ) (Expert) 27 April 2010
You don't do anything, let them heirs of the vendors to file a suit against you so that you can take the defense of adverse possession and also you can counter claim. But if you filed a suit against those persons it may be problem for you.
Raj Kumar Makkad (Expert) 27 April 2010
I concur with rajoo but if those problem creators try to take illegal possession from you then you shall have no other option to approach the court first and seek stay order against them.
