Hello:
We have a house in HYD In my father's name) which was given to a builder for constructing flats. My father expired last month (no will) and the flats are almost ready.
1) What documentation do we need to transfer the flats to my mother's name? Iam the only son.
2) What documentation do we need to transfer the flats to my name?
3) Where to apply for the above documents? What will be the approximate process time and/or cost?
4) Will there be any cost to tranfer the property to my mom/or me?

just obtain the succession certificate issued by the Tahasildar of your city and give a wardi to the concerned city survey officer to enter your and your mother's to the property.
there is no problem with the builder because he has to handover the possession to you. Being a legal heir you and your mother is entitle to inherit the flat

1. Family Settlement Deed or relinquishment deed duly registered with Registrar.
2. Same document as mentioned above.
3. Registrar and time required is just 1/2 days.

Raju garu,U dont need any document to change the Flats in u r mothers name as such,u and u r mother will be legal heirs so u will be joint owners u can relinquish u r right in u r mothers favour if u want to sell the flats which u got u and mother can sell away by signing on the sale deed,If u want the Flat to be on u r mothers name get the flat(s) mutated in GHMC in u r mothers name,Life is uncertain after u r mother it will be urs isnt it why u want to spend money now on relinquishment deed?Think n decide the options and decide.For relinquishment deed the charges are 1% stamp duty on market value and Rs 1,000/- towards registration charges

Adv Rajeev ji what for succession certificate?Is Tahsildar competent to issue the same?Plz read S.372 of Indian Succession Act.

If the market value is above 10,000/-the Civil court is competent to issue the succession certificate.
