The case is about Mutaion wrongly enter with the tehsildar office. and for correction of property details we filed the case. Other party is dead and I don't have there or there childrens where about....
We are waiting for to court to declare x party and move the case in our favour....

When a mutation entry was noted in the Tahsildar's office, you have to request the Tahsildar to make corrections in their office and if necessary, report the matter to the District Collector but why did you file case when it is mistake in Tahsils' office?

Sir, I am sorry, i don.t know what you taking about but this is how things are working in Jalandhar, Punjab.... There i some information about my property that need to be corrected... Tehsildar has no power to correct it... only way is to file case in civil court and get orders from the judge or megistrate.... for the corrction... Again the correction part.... its again a very long story.... so please drop that part....

You should have filed a suit for mandatory injunction against the authorities for rectifying the revenue details of this property and as they are refusing to do it, you can seek direction from court against them.

Details of my filed case are mention above....
case is already filed and my problem is that I think we are dragging the matter to far.... we should have close the case long before....10 month passed with over 9 court session dated past... but we still waiting for other party appearance.... we should have close the case as x party in my favour.... we are dragging lot of time in this case... where are we wrong...

You filed the case on 13-12-2024, and it has only been 8 months. Sometimes the case will run in even years. You have to wait for court orders.

10 months passes.... after 8 court session the other party never turned up....the other party is dead and I have no where about..... they will never going to turn up.... for sure...... how long it take to declare as x party...

The court can set the defendant as 'ex-parte' only after the sufficient service of summons sent and the court is satisfied about it.
If the defendant does not appear despite being ordered to do so, the court may issue an ex-parte order or decree.
This decision is based on the principle that the defendant's absence implies a failure to contest the claims made by the plaintiff.
You have to depend on your advocate for all such practical issues.

We send paper sumon 3 times but no one turn.... then we gave news paper publication after which 3 court session passes and no one turn up as they are dead. still the court gave order to wait till next date....
