Dear sir

My dad was single owner of flat. He did nomination in my mom name when he was alive.

Then society transferred flat in my mother's name after my dad expired.

Me and my sister is there.

Now what are the options available with my mom If she wants to pass on that flat to me and my sister. Also advise any other option.

Actually your mother cannot become an absolute owner of the entire property post death of your father, you and your sister being one among the legal heirs, you both are entitled to a share in the property, however if your mother relinquish her rights in the property by excuting a registered release deed, then you and your sister both will be the joint owners of the property

After demise of your father , you,your sister and mother became owner of flat and each of you have 1/3 share in said property. If your mother wish to transfer her share to you and your sister then she has to execute a registered relinqushmet deed in favour of you ad your sister and make you and your sister joint owner of property.

Yes. You, your sister and your mother have equal rights (1/3 rd each) and hence your mother may relinquish her rights over you and your sister.
