The provision for assisting the prosecution under the CrPC is primarily governed by Section 301 which allows the Public Prosecutor or Assistant Public Prosecutor to conduct the prosecution. Additionally, if a private person instructs a pleader to prosecute, the Public Prosecutor or Assistant Public Prosecutor still leads, and the instructed pleader acts under their direction.
If a private person engages a lawyer to assist the prosecution, the lawyer acts under the direction of the Public Prosecutor. They cannot independently conduct the prosecution or make oral arguments, but they can submit written arguments with the court's permission after the evidence is closed.
