hi, my friend's cross is there in divorce case. we want to know whether the lawyer writes down all the questions and then in court will read one after the other or he will ask the question whatever he feels at that time. Ideally how it should be?

In the entire case proceedings, the most difficult part for the advocate (especially advocates who have less experience)is to cross examine the witness. Several books were written on the subject.

The advocate has to read the file thoroughly twice or thrice in his office and prepare questions. While preparing the questiones, he will also have to guess what type of replies he would get and on the basis of those guesses further questions would be, probably arisen, noted in mind.

In the court, he starts to ask questions and after hearing the answer from witness, he would give slight modifications to his further questions. The ultimate aim is to prove his case by proving that the witness of the other party is not telling truth on material facts.
