Q)dhingra sir my problem iis that i got married in 2006. and i have a son but my wife and her parents are greedy. right after marriage she lodged false complaint in police/women cell etc. every time in order to save my marriage i got her back. in 2011 she filed domestic voilence and i filed divorce. but she moves to supreme court for transfer of my divorce case from jammu to punjab. but in supreme court patch up was made by justice singhvi and she started living wd me from 2013. now again 15 days back she went to her parents and refuse to come back.and very nxt day she files false complaint in police at punjab. but police rejected her complaint ask her to file complaint at jammu. till date i havent receive any summon from court or police.i want to know if she again files domestic voilence case does this show her malafide intention to harass me. in reality she alleges baseless and very pitty allegation. i need your adviceplz

Your original question was, "what are the POINTS to be rememberd IN MUTUAL CONSENT DIVORCE." Now you have come out with a new quetion entirely different asking, "i want to know if she again files domestic voilence case does this show her malafide."
If I asked you to discuss the real problem, you termed me, "so rude while replying a y query."
Contrarily, you don't have any problem for the present, as revealed from your latest post, as you want oly to know for future event, if that happens, whether malafide or not.
So, all the time you asked only academic query.
Better, at first you decide, what you actually want to know.
However, for your information dv can be any time in future also depending upon your own attitude towards your wife. Petty allegation or pretty serious case that depends solely upon the outcome of the investigation of police. SO, NO PREDICTION CAN BE MADE.

Q) if wife files domestic voilence second time can we challenge it .i want to know how i mean in which court. my wife had filed dv in 2011. and in 2013 she come back but again after 2yrs she again filed dv.and she is in habit of doing this and misusing law.

You could well have asked this question from your own lawyer.
However, you will be quite free to challenge dv case every time. But each time her scope of winning would become better as the instance can be treated as if you are habitual of repeated violence against her. In that case judge may not consider any misuse of law, rather can take serious view that law has the need to take stringent action against you to improve your habits of repeated violence against her.

Now the time has come that U better rely or depend on UR local lawyer and I am sure he will do justice to U by presenting valid points from UR side. U will be on a safe zone only if can provide valid and reliable evidences from UR side to prove that UR wife is wrong.
