Absence in cr. case

Dear Members,

in a 498a case a1(accused) can send his absence petition for being absent(for first time till date for an ongoing case of 3.5 years old)
And this can be representation through his friend.

please enlighten us

If he is present then how could he file absent petition??

He can prey the court for allowing absence on acceptable grounds through his lawyer.

A petition to condone the absence u/s 317 Cr.P.C can be filed once or twice but not continuously, consult your advocate for further issues.
