Affidavit

Can a person give an affidavit if the person has changed the name? Is it necessary that it should be published in the official gazette? The leaving certificate has got a previous name but all other bank documents and PAN is of the new name. Now for making any official document like passport would an affidavit work?

1. It must be the school leaving certificate that you are more concerned since in that old name is mentioned and likewise i do think that even your birth certificate is in the old name.

2. In that to have the evidence registered that the variously named person is the same person then you would need to file a civil suit seeking a declaratory decree that the such variously named person is one and the same person and who hence forth will be referred to the name (you choose) and that which is to be incorporated in other important documents.

3. Yes, by making an affidavit for such purpose of change of name can be made and attested by an Executive Magistrate and later such changed name can be published in the state gazette by following the due procedure required for such purpose.
