Legal advice sir..

(Querist) 01 April 2014 This query is : Resolved 
Dear Sir

Sir i am elder son (married).

My grand father during his life separated his property to me(5 acres) and to my elder brother (5 acres)

At present my father having one house and one more house on my mother name (where brother is staying with his family)

Father having own land 11 acres

Now how the share from the above we will get for me and others ( Elder sister 3 married and my one elder brother married )

Pl advice and whether i will get any share on JUST AND EQUITABLE BASIS

If the same is your father's self acquired property he can give it to anyone he chooses.
On his death though you can get your due share.

You have not mentioned that the property in the hands of your father at present is is his own and self acquired property or that he inherited the same as a share out of the ancestral property?, If the property is your father's own property, he has full rights to dispose it in any manner he chooses, without consulting anyone or without allotting any share to any one during life time and suppose he has not made any Will, leaves abode intestate, then his property will be equally divided among all his legal heirs.
