Property rights

(Querist) 14 March 2014 This query is : Resolved
My father is dead.MY grandfather is alive. No will has been formed yet. can my mother claim her share in property. the property is ancestral only. is there some law for this??
what does law say about this?

Your mother would inherit her due share from your father.
R.V.RAO (Expert) 14 March 2014
ancestral property/joint family property/coparcenary property- division can be sought any time by any rightful claimant.

since your father is no more your mother inherits his share.

since it is ancestral property ,by applying 4 generation rule of great grand father, grand father, father and son,you are also due to get an equal share in the property.
once ancestral property is divided,it becomes the self acquired property of the inheritor.
