False evidence in the court

(Querist) 01 March 2014 This query is : Resolved 
to get stay on attachment order in 125 cr.pc false evidences and false statements are given on record on the basis of these false evidences and fake statements accused got stay on attachment. The court grant stay without giving chance to the other party .
Now what action can be taken on the stay order?
Is the accused liable Under Section 340 Cr.PC ?
Section 340 Cr.PC can be read with section 195 IPC.

Yes,accused is liable but for this separate proceeding u/s 340 crpc is to be intitiaed.
