Motor accident cases

(Querist) 17 November 2013 This query is : Resolved

Sir

Pls clarify whether insurance company is absolved from its liability if the owner of vehicle do not have permit to ply in the place where accident took place? Premiums were duly paid to insurance co.
Raj Kumar Makkad (Expert) 17 November 2013
If the vehicle was commercial and was not going for repairs then it cannot be plied without route permit at the other place than mentioned in the permit and thus the claim can be got negated by insurance company.
BAALASUBRAMANNYAMM (Expert) 18 November 2013
agreed with Makkad sir.
Sarvesh Kumar Sharma Advocate (Expert) 18 November 2013
Agree with above view
Rajendra K Goyal (Expert) 19 November 2013
Well advised by the expert, nothing more to add.
T. Kalaiselvan, Advocate (Expert) 19 November 2013
If the commercial vehicles do not follow the permit rules they are reckoned as having violated the rules, thus violation of rules will have a negative effect in the claim.
