Adjournment sine die

(Querist) 04 September 2013 This query is : Resolved
A case for rent recovery was filed by the Govt against my late father before the estate officer. Legal heirs filed WS. Department did not however file the WS despite 3 dates. On the 4th date the estate officer adjourned the case sine die as the department failed to file WS. Was estate officer legally correct to do so.

Dear querist
the Govt has filed a case so the govt filed replication on your WS & not file any WS & its depend on the court to give time to them or not. arise your objection upon non-filing the replication or approach for frame issues in the case.
Raj Kumar Makkad (Expert) 05 September 2013
Estate Officer is wrong in his approach. He might have either struck off the defence of the department or might have proceeded them ex-parte.

You are now required to file an appeal against the appellate authority.
