Copy of will

Guest (Querist) 23 August 2013 This query is : Resolved
Dear all,

My grandfather has one brother and the ancestral property was distributed equally between the two brothers.

Both of them expired.

Now the copy of the will detailing the property division was with my grandfathers brothers sons.

They are saying the will was not available with them and are selling the properties. I came to know this through encumbrance certificate.

Now we don't know the property details of the will.

Is there any way to obtain the copy of the will legally?

If it is regd., then you will get it in the sub registar office, but it requires date of execution.
Apply for the property extract you will get the details.

Instead of wasting time in searching the will, you immediately need to seek partition and possession with seeking setting aside the entire sales made by the sons of the brother of your grand father and should seek stay order against further sale.
