Dear Sir,

My inlaws home was in the name of my Husband Uncle. The property he got was against a claim when they all came back from Pakistan.My father-in-law was not in Delhi during that time due to his that is why it got registered in his name. We have two floor in that house. Now the uncle and my FIL both have died and the property got transferred in my Aunt's Name. The house is freehold having 4 floors. Two Floors are with us and two floors are with her. She is willing to transfer our share to us. Please tell us what is the procedure to get this transferred in our name or my Mother in Laws name.

Get an amicable deed of partition executed between your family and that of your husband's aunt.
The partition deed must be registered one.

It can be done through any of the modes--- by family settlement deed, by Will, by relinquishment, by gift. Get them registered as well.

As the property is exclusively in the name of your aunt in law so no partition of the same can be done between your family and and your aunt in law rather a gift deed or a relinquishment deed is the best option in the given facts.

We have family property in the name of my father.Both my father and mother died few months back. The property is Leadehold. What is the procedure to sell a lease hold property. Its a ancertral house wherein one third is in the name of my father. Is there any way we can lease hold property.Will there will be any amendement in the time to come to sell leasehold property

You can sell it by executed registered sale deed but do mention about the status of the property as lease-hold.
