Divorce

Querist : Anonymous (Querist) 19 December 2011 This query is : Resolved 
R/Experts,
Petition for getting divorce filed by husband u/s 13 in the year 2009.Respondent wife appeared and resisted the petition.The matter is pending and now both parties want to mutual divorce.They are going to file joint pursis for divorce.
Can civil court decreed their mutual divorce?
Will any problem of six months waiting period arise?
If any ruling available plz. suggest.

Yes the divorce case can be converted into mutual divorce case if both the parties file a petition u/s 13B of HMA.
However there would be no respite from the 6 months time frame as that is a mandatory provision.

Why you asking for the rullings if you are an advocate than you can share it by your identification and if you are not an advocate than your advocate have charged from you for solving your problems. do it is his duty to search for the authority.
