About commercial use in residen building.

I am living in appartmen, which has total, 12 flat, in total fourth floor. on first floor two flat is in possession of builder. and his son is owner of that two flat.now the builder`s son is making a hotel in that two flat. if he make a hotel, then create many problem about pollution, parking, uses the comman passage, lift, water and many other problems. all members request him but he is not ready to stop making hotel. what we can go to highcourt to stop it? we file a any writ petition in high court?

Before going to high court. you should make complaint before development authority or Municipal Corporation, as the case may be. if you not succeed, you can file writ petition before the High Court.

The person who is going to start a hotel, ought to get permission from various authorities. You can raise objections and write letters to them.

Even after this they are getting permission, you can prefer a writ.

You should first lodge a diary to the police and submit a complaint to the Local Municipality then file a case u/sec.144 Cr.P.C.You should also file a suit for Injunction and Declaration in Civil Court under order 39 rule 1 and 2.

Municipal Corporation or the Development Authority is the authority to approach. If the authorities find violation of their rules, terms & conditions, they themselves can seal the premises and file a suit against the owners in a court of law.
