Some body passes derogatory remarks against SC person in a Public Place about his caste. Should he file the case under SC/ST Act and what are the remedies for SC person and what are the punishments for the accused person. Is it bailable or non bailable offence and in which court it is tryable.

You have to file a complaint with the police. That is enough. It is the police who will do the rest of the job. What is important to note is whether or not a person passed the derogatory remarks. That is it. What will be the punishment and whether it is bailable or non-bailable is immaterial for the simple reason, it is not in the hands of the complainant to demand a particular type of punishment. The law will take its course.

the case is a non bailable one which is triable by special judge ( Sessions Judge ).Lodge a complaint before police as suggested by other learned experts
