Can we get declaration regarding legal heirs in Civil Court.Please provide legal position also.

For legal heir certificate you have to make an application to the Tehasildar concerned. You have to attach the Death Certificate and also mention all the legal heirs, their age, relationship with the deceased etc.

Tehsildar is competent authority to issue such certificate and no declaration is required to be obtained from civil court but if difference arises on any count then only civil court remedy can be exhausted and its verdict shall be final.
