REGARDING DDA FLAT

dear sir, we have one DDA flat registered in our all 4 brother's name, and my younger brother is staying there since past 5 years, and he is not vacating the house, so please help me how to get him out, because we all other three brother wanted to sell the house, firstly to our younger brother, but he is not showing any interest, so we told him that we will sell this house in the market as per market price and distribute the money..still he is not aggreeing..we need money for our children eduction but he is not understanding our situation.. so please help me, what should i do in this situtaion..

you all are in mess.partition suit is legal
remedy but taking loan against it will be a
better strategy.

Get a suit for partition instituted. Your problem will get solved quickly. You have to necessarily approach a lawyer for this purpose.
I am afraid, getting a loan against the Flat may not be a workable solution, for your younger brother may or may not agree to sign the loan paper; and then he may or may not pay the EMIs to the bank.
