what to do if a magistrate dismisses the application under section 156(3)crpc and issues summons under IPC in a cognizable offence?
Can we file a petition before High court against dismissal of applicaton under 156(3) ?

Yes, you could challenge such order in Revision either before the Sessions court or the High Court.

The magistrate is having the power either to send to Police u/s 156 (3) or take it on file and send summons.

Yet you can challenge it.
