Rented Office Premises.

Querist : Anonymous (Querist) 10 June 2011 This query is : Resolved 
A partnership firm consist of 3 partners A,B & C owns a rented office premises in mumbai since 1975 in the name of firm M/S.ABC. During 1986, one partner, Mr.A died without making any will and leaving behind him 4 legal heirs. Thereafter, the business of the firm remain continue in the same name and rent receipt was also remained unchanged in the name of firm M/S.ABC consist of old/same 3 partners A,B & C. During 1996, the entire firm has been dissolved and as per the sharing terms, the above office premises has been given to Mr.A (who dies during 1986). Till now, no one from the family of Mr.A has has intimated the landlord about the death of Mr.A and the dissolution of the firm. Hence, till now, rent receipt has remain unchanged i.e. in the name of M/S.ABC.

Can I, as a one of the legal heirs of Mr.A claim my share of interest in the the said office premises ?

why you are keeping quite after 1986 and who is paying rent now.

settle amicably with landlord otherwise it will be lengthy court battle.

actually the partner ship was dissolved in 1986 when A dies.but the firm name was unchanged and the rent was also received by the landlord. now the firm is dissolved and only the firm is the tenant in the premises. if the firm goes everything goes and it shall be subletting which a ground for eviction.
