when two vehicle were classed and one of which capsized opon a padetrian who died on spot ,case has been filled against the one vehicle which was capsized, is the vehicle will only liable?

Its depend upon the accidents status.. Usually if two vehicle involved with a road accident mean the charge will lodge against the heavy vehicle only. In case if both vehicle got damage mean both vehicle liable.

On which vehicle chargesheet is filed? If chargesheet is on only vehicle then the ins., co., of the vehicle liable to pay the compensation if there is valid insurance and driving license on the date of accident
