any time limit for police to file challan basis FIR. If police does not file challan what happen to FIR Status

most of the time challan is filed with in 90 days from the date of the arrest of the accused. if the accused is on bail than no limitation it can take 6 months even but when accused is in custody the days are only 90 for the police and if not filed the challan in 90 days the accused will be released u/s 167 Cr.p.c. even the challan is produced at spot at the time of filling of the application for bail.

There is nothing in the CRCPC which prescribes the time for submitting the charge sheet within 90 days. The time of 90 days is taken into consideration only for considering the bail application as after 90 days if the police fails to submit charge sheet the accused person is entitled to get bail as a matter of right.

if challan not filed within the scheduled period as mentioned in section 167 Cr.P.C and also police did not pray for time mentioning specific reasons for filing challan after schedule period, the magistrate has power to pass order for closing the case and stop further investigation and discharge the accused from the case.

As per section 167 r/w section 57 of the cr.p.c. the police has to submit chalan within 24 hrs. if he has arrested the accused, if he can't then he is bound to produce the accused before the magistrate for remanding him to judicial custody and then he has to complete investigation within 60 or 90 days and except this there is no time limit.
