Not chargesheet

RESPECTED EXPERTS,
Mr. A and Mr. B was arrested on section 411 of IPC and was enlarged on bail.After investigation Police filed charge-sheet against Mr. A not against Mr.B.

Now my quires is that is above meant that Mr.B is discharged from case.??

As Mr. B is not charge-sheet by investigation agency what is the other legal option opened to Mr.B to avoid for legal complication.

any other advice is welcome.

It is not the case that B is discharged. The court is having all such power to include B as the accused at any point of time. Only on the final verdict the B can get discharged.

It means that Final Report(Closure) is submitted in respect of B.In that event the de facto complainant has enough opportunity or right to challenge such Final Report and on his protest the court may take cognizance against B.
