Transfer of court Petition

Respected experts,

My matter is placed for final order as the Defendant has not filed his written statement till date.

In this case What is the procedure for transferring this civil matter from one court to another ?

The Judge of the court in which my matter is pending has met with a serious accident and has not come to the court since a month.

move the application before the District Judge for transfer of the Case. however, since WS has not been filed the case may be proceeded exparte and it may not be that judgement is awaited.

If Written statement has not been filed by the defendant try to proceed the case as exparte. If the court is on leave in which your case has been pending you can not do any thing. If there is any urgency in your case then move an application before the HC for early disposal of the case.

Filed transfer petition before District Court U/s 24 of C.P.C. If the Court satisfy about the grounds of transfer of case, then the matter may be transfer to other Court.
