Querist : Anonymous (Querist) 22 December 2010 This query is : Resolved
hi
my question is what is the benefit of joint holder of property in the event of death of any of the partner as we have a shop which in joint name of my parents 1st holder is my mother and 2nd holder is father and my father is died without any will or nomination and my mother has made a will favouring myself and i have 2 sisters?

Your mother can bequeat only her share and not that of your father. The legal heirs of your father will inherit his share of property in equal share.

Two Joint holders will be generally having 50 % each share - Your father & Mother - Father died with out any Will Deed - his 50 % share to be succeeded by his wife , 1-son and 2-daughters- Mother can execute will deed in respect of her share 62-50 % ( her 50 % + 12-5 % equal share with sons & daughters out of her husband 50 % Share ) in the property /shop!
