CAN OFFER OF APPOINTMENT TO A GOVT SERVANT FOR A HIGHER POST IN THE SAME DEPARTMENT (WHICH IS ACHIEVED THROUGH DIFFERENT EXAMINATION IN WHICH C.O. IS THE SINGLE CANDIDATE TO COMPETE ON ALL INDIA LEVEL) CAN BE CAN CANCELED ON THE BASIS OF CHARGE SHEET ONLY? LATERON C.O. IS EXONERATED IN THE DEPARTMENTAL PROCEEDING ONLY TO SERVED DISAGREEMENT MEMO.

It depends upon the gravity of the charge. If anyone else stands equally with you and without any charge,he can be preferred certainly.

If the offer letter is already issued, that can be canceled just because the charge sheet is filed latter.

Once officer is made, the same can not be cancelled merely on the ground of the person is charge sheeted. Moreover, in case, the person is held guilty after disciplinary proceedings, he can be reverted back to his substantive post by way of punishment i.e. reduction in rank.
