parallel appeal

Guest (Querist) 28 November 2010 This query is : Resolved
Can same order of CAT be challenged before high court under 226 and also seperately in appeal before supreme court also?
If not how the appeal before supreme court is barred by petition under 226?
Devajyoti Barman (Expert) 28 November 2010
No
Writ before the Supreme Court lies ubder Article 32 of the Constitution, not under Art 226.
You are contemplating something which is a clear abuse of the process of court and absolutely barred by law.

yes

Mr. devjyoti kindly refer me to the order/citation, where a petition under article 226 bars a statutory appeal against the order of CAT, permissible under AT Act 1985.
Advocate. Arunagiri (Expert) 29 November 2010
Please provide the order/citation.
