plaintiff/wife lived with her parents for past 8 years, and she is working. any exception for husband to give mantenance to wife?

U/s 125 crpc ,a woman who is able to maintain herself and has left her matrmonial home on her own accord is not liable to any maintenace from her husband.

If wife has got independent income she is not entitle to claim the maintenance. Husband has to prove that wife is earning.

agree with experts. husband has to prove that she has sufficient regular earnings and also she is living separately without valid reason.
