I am appearing for a complainant. The accused has obtained an Anticipatory Bail and the case has been numbered and the charge sheet is yet to be filed.
I doubt that the accused might flee out of country to avoid the legal actions.
1. Under which Sec of Cr.P.C gives the complainant to seek the Magistrate to direct the Accused to deposit the Passport.??

U/S 439 CRPC. IN this case passport would not be seized.

On mere apprehensions, the court cannot pass any such orders to confiscate the passport. It has to follow the procedures laid down for the purpose and will act only when it warrants for such a situation.
