My wife has filed Domestic Violence case in June 2013, the case is pending at Argument Stage where we have filed our say, The custody of my physical disabled baby child is with me. last week she has undergone a medical surgery and have been plastered on both legs & right hand. the total cost of the surgery was nearby 1 lakh Rupees. Till date my wife have not asked for her temporary custody/visitation charges, not she have gone for interim maintanance apart what she asked casually in her say.
My concern related to this are: -
1) i want long date near about after 2 months where i can take care of my child in this condition? what shouls i do?
2)I want to bring into notice of honorable judge that i m looking after her properly as i am a caring father, here should i submit the hospitalize paper in coming date, which will help me to keep her custody and bring down maintanance if applied in future.
3) Till time she should have applied for interim maintanance which she have not, in interim maintance we can fight to reduce the maintannace but we cannot bring to zero, She can say later that i am caring and looking only after my child, so should i wait for her maintanance application OR is there any process where we can say i am ready to give wahtever pssible by my end till the case result come, which will be a benefit point at my end to fight further.
Please suggest.

what is your salary? was your wife prior to accident working? what are her qualifications ?
go and meet your wife and inquire about her health . take the child along . however before going talk to your in laws . if they have no objection then visit your wife . the presence of child will cheer her up . as fr as maintenance is concerned take a cheque along for figure you are comfortable with and give it to your wife .

You are taking care of your child. You should file the hospitalization papers at the time of hearing of maintenance case.
Meanwhile collect all other proofs of the salary of your wife, if any.
You have not mentioned if she is having any child from wedlock with her and what is your income?
For longer date you can request the court through your lawyer and court may agree.
From your name it seems you are Muslim and if so, you may proceed for divorce as per your personal law.
